Welcome to Cultagrix! By accessing or using our mobile application, website, or services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

These Terms constitute a legally binding agreement between you ("User," "you," or "your") and Cultagrix ("we," "us," or "our").

2. Description of Service

Cultagrix is an AI-powered farming assistant designed for farmers worldwide. Our Service includes:

• AI-powered crop disease detection from photos
• AI chat assistant (Cultagrix AI) for farming advice with global farming knowledge
• Weather forecasts and farming recommendations
• Crop management and tracking tools
• Expense and profit tracking
• Daily farming journal
• Yield prediction and market insights
• Multi-language support

3. Eligibility

To use Cultagrix, you must:

• Be at least 18 years old
• Have the legal capacity to enter into binding contracts
• Provide accurate and complete registration information
• Have a valid mobile phone number for authentication
• Comply with all applicable laws in your jurisdiction

4. User Account

4.1 Registration

To access certain features, you must create an account by providing your phone number, name, and location. You agree to provide accurate, current, and complete information.

4.2 Account Security

• You are responsible for maintaining the confidentiality of your account credentials
• You are responsible for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account
• We are not liable for any loss or damage arising from unauthorized account access

4.3 Account Termination

You may delete your account at any time through the app settings. We may suspend or terminate your account if you violate these Terms.

5. Subscription Plans and Payments

5.1 Free and Paid Plans

We offer three subscription tiers:

• Free: Limited features, always free
• Basic (₹299/month or ₹2,999/year): Full AI features
• Pro (₹699/month or ₹6,999/year): Advanced features for farming businesses

5.2 Payment Methods

We accept payments through:

• UPI (Google Pay, PhonePe, Paytm, etc.)
• Credit/Debit Cards
• Net Banking
• Mobile Wallets

5.3 Billing and Renewal

• Subscriptions automatically renew unless cancelled
• You will be charged at the beginning of each billing period
• Prices are in Indian Rupees (INR) and include applicable taxes
• We will notify you before any price changes

5.4 Cancellation

• You can cancel your subscription anytime through the app
• Cancellation takes effect at the end of the current billing period
• No refunds for partial months or unused time (except as stated in Refund Policy)

5.5 Upgrade/Downgrade

• Upgrades are effective immediately with prorated charges
• Downgrades take effect at the end of the current billing period

6. User Conduct

You agree NOT to:

• Use the Service for any illegal or unauthorized purpose
• Upload malicious code, viruses, or harmful content
• Attempt to hack, reverse engineer, or compromise the Service
• Share your account with others or create multiple accounts
• Scrape, copy, or download data through automated means
• Impersonate others or provide false information
• Abuse, harass, or threaten other users or our staff
• Use the Service to spam or send unsolicited messages
• Violate intellectual property rights
• Circumvent subscription limits or payment requirements

7. AI Services and Accuracy

7.1 AI Recommendations

Our AI-powered features (disease detection, chat assistant, yield prediction) are provided for informational purposes only. While we strive for accuracy, AI recommendations should not be considered as professional agricultural advice.

7.2 No Guarantee

We do not guarantee that:

• AI disease detection will be 100% accurate
• Following AI recommendations will result in specific outcomes
• Yield predictions will match actual results
• Weather forecasts will be error-free

7.3 Your Responsibility

You are solely responsible for your farming decisions. Always consult with agricultural experts, agronomists, or local authorities for critical decisions. We are not liable for crop losses, financial damages, or any consequences of following AI recommendations.

8. Intellectual Property

8.1 Our Rights

All content, features, and functionality of the Service (including but not limited to text, graphics, logos, icons, images, audio clips, software, and AI models) are owned by Cultagrix and protected by international copyright, trademark, and other intellectual property laws.

8.2 Your Content

You retain ownership of the content you upload (photos, notes, journal entries). By uploading content, you grant us a worldwide, non-exclusive, royalty-free license to use, process, and analyze your content solely to provide the Service and improve our AI models.

8.3 Restrictions

You may not:

• Copy, modify, or distribute our content without permission
• Use our trademarks or branding without authorization
• Create derivative works based on our Service
• Remove copyright or proprietary notices

9. Third-Party Services

Our Service integrates with third-party services (Google Gemini AI, OpenWeatherMap, payment gateways). We are not responsible for the availability, accuracy, or content of these third-party services. Your use of third-party services is subject to their respective terms and privacy policies.

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

18.4 Assignment

You may not transfer or assign your rights or obligations under these Terms. We may assign our rights without restriction.

18.5 Language

These Terms are written in English. Translations in Hindi and Marathi are provided for convenience but the English version governs in case of discrepancies.
